Failure to insure DVLA

My daughter left the UK on May 28th for a summer job in Spain. While she was away her MOT and insurance ran out. The insurance on Aug 3rd. When she arrived home on Sep 2nd she opened her post and found two letters, one from MID telling her she had to renew her insurance and one from DVLA saying a fixed penalty was due (£50 if paid by Sep 4th rising to £100 if not) I rang to pay the penalty on Sep 3rd only to find the lines not open on a Saturday so decided to appeal.
We sent a covering letter including a copy of her assignment letter (clearly showing the dates she'd be away) and explaining the circumstances and today received a letter back saying she still has to pay the £100.
The car was parked on our drive the whole time and was insured again so she could use it on Sep 3rd.
The only phone number on the letter is a payment one and the letter says if payment is not received the Agency will take court action.
Anyone have any ideas?
