Parking Eye and Small Claims Court
willnotpay
I recently received a small claims court, as parking eye wanted £100 plus other fees for me parking on a car park when I went into LIDL somewhere in London (dont want to mention where).
I stayed for over 2 hours since I was shopping in LIDL and well as Farm Foods which was nearby. This happened earlier this year.
I no longer longer have the receipts I collected from my shopping but I want to fight this small claims. I have responded to the court acknowledging receipt. I now need to put together my defense.
I would prefer to discuss with forumnites who are well versed in these and would also appreciate any help from anyone as well.
Thanks

OK, you will get help from regulars when you show us a draft defence on this thread, not by private message (do not reply if you get a pm from a non-regular with less than 1000 posts here).
So, to find similar ParkingEye defences, search this forum for 'ParkingEye defence' and read some recent ones.
Have to warn you, unless PE sent the PCN very late and didn't include the warning about the POFA 2012 ('after 29 days'...blah blah...'we will have the right to seek the charge from the registered keeper') you might struggle to defend this one. An overstay at a retail park that offered free parking for the first two hours is too similar to 'ParkingEye v Beavis' for comfort.
TBH I would be asking Farm Foods Head Office (forget Lidl in this case) and the overall landowner or their site agent, to step in and help you negotiate a settlement of £50 or so, if you want to get this ended sooner. I am not saying that lightly! I'm saying it to be realistic since the ParkingEye v Beavis case (Google it...the Supreme Court did not help your case and you should never have ignored the parking charge).
So, did the PCN in the post (with the photos) have the wording I described, lower down, or not?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
