    Yes, yes and yes!

    It would not be a counter-claim as it sounds like their claim is over (but check with the court). If they say it is not discontinued, send a witness statement and evidence in, and include the NoD with it.

    But MIL victims have grounds to issue a claim, it costs no more than £35 as an up front court fee to file a claim for under £500 for the tort of data misuse; so you may as well claim £499 and you can also reclaim your court fees if you win, This is a new effort at a fightback and so we would need to assist you to word it but MIL cases seem perfect for this issue, due to the fact there is no valid assignment and DVLA data cannot be passed around to other companies for any old firm to 'have a go' at collecting money from you.

    You would be claiming against the parking firm and MIL (the named assignor and assignee) as jointly and severally liable for unlawful sharing and processing of data, outside the DPA principles. See the above blogs.

    Six years, same as the PPC had, same as any debt claim in England/Wales. I suggest most people here at least wait till they see a win or two reported.

    In the meantime, everyone with grounds for a DOA Claim must first make a decent, strong ICO Complaint, to try to get an 'upheld' ICO decision to use as evidence for the claim.
