Last minute ground rent problem

Really hoping someone with more knowledge/experience can help us out here.


Basically, we're selling our house; it's a Victorian terrace with about 800 odd years left on the lease. We used to get invoiced for the ground rent but this seems to have ceased in 2014. The ground rent is the princely sum of £1.65 a year. The upshot is that we haven't paid it for the last 2 years.


The solicitors, 3 days before we were looking to exchange, have asked that we contact the leasehold company, pay the arrears owed and obtain a receipt.


I've downloaded the details from the land registry and cannot find the company at the address listed. I expect that, given some time, we could probably find them but I can honestly see this taking ages to sort out.


What I'm asking is if anyone knows if we can pay the solicitor some money "on account" so that it can be settled post completion or even if there is some sort of indemnity policy we could obtain so that the new owner will not be pursued for any arrears.

    It may be possible to agree to a retention (the solicitors holding some money).

    Do you still have the older receipts or invoices?
    All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)
  • Landlords often own whole streets so it might be worth asking neighbours?

    Get old bank statements to see who you paid but this could be a long shot.

    If all else fails you may be able to get an absent landlord indemnity policy or similar.
