MBNA - No records

Hi, I'm new to all of this PPI reclaim business as I thought I never had it until I checked!

MBNA who I had a credit card with have responded that I had PPI and confirm that my complaint is valid.

The only thing is that they say they have lost my records and offered to refund £408 which covers May - December in 1999, I had the card from 1997 - 2012 and in 1999 it was at it's lowest balance, between 2004 and 2010 it was considerably higher.

What do I do now, if they are only paying for a few months they should be refunding an awful lot more. How can they find really old records where the card balance was low, not the more recent stuff where it was a lot higher, this just doesn't seem right?

  • If you can provide statements from your own archive showing you paid more, then they can work from these and will refund more. If not, you are reliant on the Bank's archives.

    However, your records really should still be available if you only closed the account in 2012, so you could also send them a Subject Access Request (SAR) to see exactly what they have. If the SAR reveals that they no longer have any records post 1999, though, you'll just have to accept their offer.

    Is there a template where I can request a SAR?

    I have odd statements from 2008 through to 2010 showing a very high balance throughout and printed online bank statements dating back to 2006 showing a DD of the minimum payment plus additional payments made. The DD's are reflective of the high balance all the way through from 2006 which is as far back as I can get with online statements.

    Is this kind of evidence enough for the FOS?

    Direct Debit amounts won't show how much was PPI. Don't you have any credit card statements ? These would have had any PPI itemised on a separate line.

    I'm afraid evidence that you paid your credit card bill is not evidence of how much (if any) PPI you paid.

    It's even possible you cancelled the insurance after 1999, which would explain why the Bank seemingly have no records and also why you didn't know that you had a policy. If you've forgotten ever having a policy, it's also not unlikely that you've forgotten cancelling it 17 years ago.
