Returns at CEX Sony Smartwatch 2

So I bought a Sony Smartwatch 2 from CEX two months ago now.

Everything was working fine and well until 2 weeks ago it crashed and wouldn't respond so i basically just turned it off and on again and it was fine.

On Thursday 15 Sept it crashed again and when i managed to turn it back on it said dead battery so i charged it all morning then when i turned it on again to use there was a mark in the screen but i haven't dropped it or hit it as there isn't any damage to the actual screen just beneath it.
the screen or buttons dont respond but i have read online other people are having the same problem.

So i went to CEX in Ashton where i got it from on Friday 16th Sept bearing in mind i live in Denton so I walked well over an hour each way to get there.

The woman behind the desk said shell send it off to Sony but they probably wont do anything as its accidental.

What is the point of a guarantee and a warranty then?
Surely there must be some refund for under 6 months?

I got a phone call in work today Monday 19th Sept from a private number it was CEX woman saying they couldn't repair it.
they clearly haven't sent it to Sony at all they lied saying they would sent it off.

What can I do as i now have £50 wasted?
Any help or tips or just some way to try and get some money back please.

    Isn't the item previously owned when sold by CEX? If so, I doubt you'll have any manufacturer warranty and CEX won't replace or refund if the item has been damaged.

    You could arrange for an independent inspection, but unless it found the item to be faulty rather than damaged, you'd have to pay for this yourself...

    Cex are known to avoid the responsibilities to the consumer. I'd expect a fight and threats of further action before they do anything.

    Try using their Facebook and Twitter to contact them but expect a long wait for a reply.
