Warranty Issue

Hi,
I have recently purchased (17th Dec. 2015) an Audi from an Audi main dealer through their approved used scheme. Flagged up a gearbox error and I took it in - clutches getting too hot. Audi health check was completed during a short diagnostic, not a huge priority, however the gearbox oil change is overdue - agreed to have this done on the service which I'd booked a week/two weeks previous. Issue progressed into a full break down a week ago.

Had the car taken on a flat bed last Sat and was provided with a courtesy car...then things got interesting.

Call on Monday, can you please bring in the service book. As I know a lot about these cars, I know that the warranty company always want to know if the gearbox oil and filter was changed on time. Dropped off the book and had a quick look myself, three ticks on the s-tronic gearbox section through the history...all good I thought. Phone call on Monday night, gearbox is damaged and the seller missed the service so warranty is void. Don't worry though, the seller (Audi dealer, same nationwide company) is paying as they should have done it before delivery. Excellent I thought.

All goes quiet for a few days. Another phone call from warranty specialist at the dealership, need you to authorise diagnostics as the warranty company won't pay for diagnostics on equipment that hasn't failed. Immediately confused as the last conversation was different.

Then, alarm bells started to ring. Last gearbox oil change was at 44k (not at 38k as per the service schedule but nonetheless done a while ago) and gearbox services should be done at 40k, making the next one due at 84k, which is conveniently within my ownership period (I bought the car at 78k). Haven't heard a peep since.

My thoughts:

Was actually booked in for service before any of the problems surfaced whatsoever. I'm hoping that they are all they are trying to do is pin it on the warrantly company to avoid paying themselves, however it's a bit worrying now they are discussing the fact that the oil change should have happened on my watch (even though I was booked in a knew nothing about this oil service until their health check pointed to the fact that it's overdue). I'm quite confused by the conflicting information.

I put trust in a premium brand approved used so I'm covered...turns out it's possibly not worth the paper the warranty is printed on. A mate of mine said the S4 service is every 38k, so it should (assuming that the first one wasn't late) be 76K, which puts in before my ownership. Really, the selling garage would have known it was more or less due but chose not to do the service to cut costs after I didn't take any of their extra products. I suppose what would one call late on a due service? On the nose? Before it hits that mileage? It's actually got three s-tronic ticks in the service book so there is absolutely no way on earth I would know if it was due or not, until Audi's health check said it's due. Setting me up for a fail I think.
