    Where are the pictures of the signs that you took? You need to include them so the assessor can see what you are talking about.

    Bumping is where a thread has dropped off the first page(s) and someone makes a post just to "bump" the thread back up to the front page.

    The last one (taken at night) is more relevant as the car was parked at mid-night.

    Those are good pictures. Use the entrance one taken at night if that's when the parking event allegedly occurred. Point out that the sign is at right angles to vehicles entering the car park so wouldn't be seen by a driver, especially if approaching from behind the sign and turning right into the car park.
    The one behind the bushes is hard enough to see in daylight so would be virtually impossible to see at night.

    This is what you should be firmly pointing out to the assessor.

    That POPLA appeal is good to go once you've embedded those pictures into the signage point, to break it up and illustrate what you are saying. Keeps the POPLA Assessor awake, I like to think, better than attaching the signage pics separately.

    Then save the document as a PDF and upload it under OTHER on the POPLA webpage.

    I received this message from POPLA today:


    Upon review of the evidence I am not satisfied that the driver has been identified sufficiently. In order to transfer liability from the driver, to the registered keeper of the vehicle, the strict provisions laid out in the PoFA 2012 must be adhered to. In this case no evidence of a Notice to Keeper has been provided, and I can only see that a Notice to Driver has been issued. As the operator is not seeking to pursue the keeper under PoFA 2012, only the driver can be held liable for the charge. However, after considering the evidence, I am unable to confirm that the appellant is in fact the driver. As such, I must allow the appeal on the basis that the operator has failed to demonstrate that the appellant is the driver and therefore liable for the charge. I notice that the appellant has raised a further grounds of appeal, however as I have consider PoFA 2012 I need not review the other appeal grounds raised. Accordingly this appeal should be allowed.
