Waiting for probate

After mum passed away in January we applied for probate after consulting a solicitor who said it would be straight forward to do ourselves rather than pay them 1000s to do it. We sent the forms off early February with the £215 payment and after various requests for more information we received a letter at the start of May stating the 'application for grant of representation has been received'. There has been nothing since.

Does anyone know how long it should take? as I am wondering if I should contact the probate registry as its been 4 months or would i be better to wait?

Contact them - it should all be over by now. Unless there is a house sale involved there should be no reason for a hold up. My mother died early Aug last year & probate & money share out was completed by early Nov.
  • Contact them and ask as it should be done by now.

After my mother's death, it took about 3-4 weeks from application date to the date when I received the Oath to make, then a further 2 weeks or so to receive the official Grants of Probate.
That was using the Cardiff Probate Office -can't believe that the rest of the country, is suffering such severe delays -as per previous post, was the estate liable for IHT? -If so, then the tax office is probably the issue - they appear to be snowed under!! It took HMRC nearly 6 months to process a claim for repayment of income tax paid prior to death -and it was only a couple of hundred quid!!
  • OK, thanks i'll contact them & find out whats happening/gone wrong.

There is a house, but there are no plans to sell as of yet

The total estate is less than the IHT limit; so as far as i know there isn't any to pay, even if there is none of us named on the probate application have heard anything back from any office since may.

Did you use IHT205 or IHT400 if the later I think probate office may still need clearance from HMRC

the call should identify the delay
  • IHT 205 and PA1
