Permit Car Park Ticket

Hello everyone, l visited Oldham Hospital and could not find a free blue badge parking and l then parked my car in a permit car park and displayed my blue badge. I received a PCN from Civil Enforcement Ltd and l submitted my appeal stating that l had displayed my blue badge. My appeal was unsuccessful as Civil Enforcement felt that the ticket was correctly issued in accordance to their t&c. l was given the option to pay at the original reduced charge of £35 or to appeal to POPLA and was given a verification code to submit appeal within 28 days. l have missed the 28 days to appeal to POPLA as l was out of the country (l have evidence - travel itinerary/e ticket). Can l still appeal to POPLA even if its after 28 days? If so please can you help me draft an appeal to POPLA.
l have in the meantime received a Notice to Keeper from Civil Enforcement Ltd stating that l failed to pay the PCN within the time specified and are now demanding £70. Civil Enforcement Ltd are still open to representations within 28 days of the new letter dated 14/09/16. Please kindly advise.

    If you were there for treatment then there's a good chance they can get this squashed. You need to be assertive though and stress the blue badge issue.

    Whilst parking companies and the likes of PoPLA only give you days to appeal, the UK Government says different.
    Changes in EU law last year say that appeals should be allowed (Alternative Dispute Resolution) for up to a year so it is always worth a late appeal, adding that you were out the country and you have a disability and are covered by the Equality Act 2010.

    "It is the will of Parliament, as a result of the EU Consumer Rights Directive, that ADRs must imminently be made available for not less than a year."


    Nobody here will advise you to pay.

    As above, complain to PALS as well. Local and national newspapers (especially the daily wail) may be interested in your case as well.

    For future reference, please read the Sticky thread for NEWBIES and show it to everyone you know in case they ever get an unfair private parking ticket as well. It explains the best way to appeal, especially explaining why you should not normally reveal who was driving.

    Yes but only for a few days after the 28 - try the code in the appeal box on POPLA's webpage and you will know if it's OK today.

    If so, DO NOT RUSH A RUBBISH APPEAL TO POPLA, COME BACK HERE AND TELL US!
