    I am deeply disappointed. Those scones haven't risen properly. Does this mean that GM is more likely to talk about cake than bake one?

    I think you're well on the way to a solution; but it really is worth sorting this out. If, when you eventually come to sell on your property, and, if like mine, your solicitor is very precise, they will give your buyer the title plan and ask them to inspect to confirm that the boundaries are as shown; i.e. that they are actually getting what the plan says.

    When a mate of mine was buying and did the same, he discovered a minor discrepancy; and because he was equally @rsey about detail, on the strength of the glitch, he delayed the sale pending a resolution or a cash discount.

    So worth sorting before it gets fossilised!

    If they acknowledge the mistake you could offer to sell them that bit of land of course rather than redo the fence.

    May cost an amount in fees which I would expect them to fork out....

    A logical response to this - and I certainly wouldnt give them the land in OP's position.

    But - the cost of an extra bit of land seems to be basically:

    - "Marriage value" - ie half any extra value that piece of land will add to the house
    - The buyer paying both sets of legal fees

    I don't think it would be worth the buyer literally paying for it (as there wouldnt be any "marriage value" - as that amount of land wouldnt increase the value of their house).

    What would be an idea would be a barter type arrangement - ie OP lets them have this bit of land in exchange for something of the non-monetary value (eg help with a decent size project on their home if they have the skills? decent amount of ongoing food produced by their garden?).

    I would say that letting the neighbour transfer that bit of land to their ownership would need to be properly documented either way - ie in order not to have any queries raised by potential future buyers of OP's house. There is a good chance they would say "Why has the next door neighbour got a bit of your garden?" and want to know whether they had acquired it legitimately or nicked it.

    Easiest thing all round for OP to take back their bit of garden imo. (I've certainly studied photo of house for sale recently and saw the bottom bit of their garden didnt quite seem to be theirs - and would be asking vendor if it was really theirs or they had nicked it courtesy of "adverse possession") and would rather lose interest if I got the wrong answer to that question....(to give how it will look from the pov of that neighbour concerned).
  • I finally met the owner on Sunday evening. It's her first house, she lives alone and wanted to enhance security by putting up a fence rather than just having her back garden open at the rear. She was very apologetic and we came to an amicable solution. She can keep the fence as is and we'll adjust the boundary. The builder came to finish it off yesterday and checked with me first that it was acceptable.

    Sounds like the previous owner of the house left her plenty of issues to deal with (oven and toilet that didn't work, took white goods she said would be left etc.,).

    So all good, and a reminder that people are generally not out to cause trouble.
