You need to read the NEWBIES thread near the top of this board, the heading called 'Small Claim?' and all the advice & Links under that. You will find how to write a defence and what to do when, including urgently acknowledging the claim.

Well sadly the news is that I am being taken to court by ParkingEye next week. I received a letter asking if I wished to use the mediation service and filled that in saying yes, but heard nothing back from them. When I phoned the mediation service last week I was told there is nothing they can do now. I have sent them an email of complaint but no response.
Apparently Parking Eye will not be attending the court date, they are just sending their agent from LPC Law. I will not be attending either as it is impossible for me to get out of work and I have no lawyer/representative. On the assumption that I am going to lose, what can I expect in terms of costs, CCJs?
Or is there anything I can still do?0 -
You could try to settle with PE before the court case - they might be able to cancel the services of the LPC agent and save themselves some money. Contact them and make them an offer.
You'll need to bear in mind that they will have spent £25 on court filing fees, around £10-£15 on postage and paperwork, £2.50 DVLA fee. Maybe around £50-£60. Some have been settled at around £30 (from vague memory), but I don't think they were so close to court.
You only get a CCJ that trashes your credit rating if you lose at court and don't pay any costs awarded against you within the time period specified by the judge (1 month is the norm).

You will lose. This was all pointless then because you had to attend. Can you really not attend? You do not need a solicitor.
You might pay about £190.

If you cannot get there, and you have a really good reason for such a late request you can ask for an adjournment even at this late stage. A judge would decide whether your request will be granted
If you do have a good reason then contact the court (saying work commitments won't be good enough - you had plenty of notice, and should have applied for a change of date as soon as you could), and claimant immediately to get this moving. (A fee will be payable to the court because you are so late with the request)0
