Popla appeal

Hi I need a bit of help with my appeal.I received a parking charge from smart parking and obviously appealed, They decided to uphold the PCN (no surprise). Now I need help to appeal it I have a POPLA code but unsure of how I word it.
Short story I was driving and came across quite ill, to the point I felt quite dizzy. So I pulled off the road into a car park I stayed for 21 minutes until I felt it safe enough to continue my journey. I didn't purchase a ticket as to be honest it never crossed my mind, plus I had no intention of leaving my vehicle due to feeling so ill. Then low and behold I received the parking charge notice.
If it helps it was just a car park on private land not Asdas or nothing like that.
I would be grateful for any help on this matter.

    Search the forum for 'Smart POPLA'. You will find winning examples from recent weeks/months to plagiarise, then check with us your cobbled-together hybrid version for comments before you submit it as a PDF attachment using 'OTHER' on the POPLA website.

    You cannot win at POPLA using mitigating circs like illness.

    Apart from an introduction which sets out briefly what happened (useful in your case) you need to steer the appeal away from that and go for the 'usual' wording (see other POPLA appeals on here), including the fact there was no reasonable grace period (20 minutes being unreasonable for an ill visitor forced to stop temporarily but seeing no contract signs at all).

    And cite VINE V WALTHAM FOREST which you will see is included in a template 'unclear signs' POPLA argument I posted at the weekend in the top thread 'POPLA Decisions'. Have a look now at the end of that thread and find the 'unclear signs' long appeal point and use it as one appeal point of several, because illness was what caused Miss Vine not to be deemed to have entered into a contract/she saw no signs as they were not prominent & she was ill.

  • I didn't name the driver although the letter was in my name, I stated the driver was ill and pulled into the car park.
  • Ive been through an hour and a half of posts and I'm still unsure of what letter template I should use. I'm really stuck now and need more help please!
