Help!!

Hello there! Some advice needed. I parked my company vehicle legally on a private pay and display car park purchasing a £2.00 ticket for all day parking. Some monkey with a camera took pictures of my vehicle and issued a penalty notice but it went directly to the vehicle lease company who automatically paid it (£95.00 with administration fees) which according to all reports is the last thing to do as it's like accepting I was in the wrong. I have appealed once already online to premier parking who issued the notice but again they rejected it telling me I can't go through popla. I have appealed again but not heard anything yet and the BPA have told me to seek legal advice!! Any body out there know what to do with this one! Any advice appreciated. Davy C.

    Has the payment been taken by credit card or a direct charge to the company/yourself?

    What is the exact wording of your lease/hire agreement?

    See if the clause is worded 'fines'?

    If the clause is worded badly you may have a better chance of getting the money back by recharge by the CC company (if applicable).

    Trying to get the money back off Premier Parking will be extremely difficult I feel.

    There has been a number of cases on Pepipoo which will might be helpful. Search: PCN with hire or lease car.

    I think somewhere I have read that there is an agreement regarding procedures which lease companies have to follow.

  • Payment has been made from the lease company then it is taken from my salary later this month. I am in contact with the lease company but there's not a lot they can do.Thanks for the reply.

    A little more detail would be handy, including:

    - what is the exact name of the parking company e.g. Premier Park Limited or Premier Parking Solutions Ltd? If it's Premier Parking Solutions Ltd then POPLA would never have been a possibility because this company is now under the IPC approved operator scheme rather than the BPA.

    - when you say that the parking company issued the notice again, who did they issue it to?

    - what is the name of the lease company?

    - who is the named hirer on the lease agreement (you or your employer)?

    - has the lease company sent you or your employer a copy of the Notice to Keeper that they received from the parking company?

    - what do the terms and conditions of the lease company's hire agreement say about admin fees and payment of private parking charges (as opposed to "fines" and "penalties")?

    - what does your employment contract say on the matter?

    Put the charge into dispute with your employer or whoever does the salary deductions. Get your Union rep involved in this scam.

    Play merry hell with the lease company for paying a speculative invoice thereby denying you the right of appeal.

    Dig out your lease agreement for the exact wording that I am sure will mention fines but not private parking charge notices (speculative invoices.)
