Leaving earlier than the Agreed Redundancy leave date

Hi ,

Basically my situatuon is. I have been full time employed at the compny for 5 years and was told in May-16 that I would be at risk of redundancy. I therefore agreed to take Voluntary redundancy which an agreed end date of 30th November 16 was agreed in May.

Since then I have accepted a job offer which I will start employmeny on 3rd October 16. I have not tried to bring forward my leave date as I knew this would not be accepted due to many other members of the team leaving (some at risk of redundancy and some not)... However I have handed in my notice of one month and had my notice accepted. But my firm have not mentioned in their 'notice achknowledgement' to me anything about my redundancy payment which I think I am due.

Therefore am I still able to qualify for redundancy and the terms even though I am leaving early.

The reason for my November 16 end date originally was to train an outsorucing company of which will be doing the work who have travelled over for 9 weeks of which we completed their training last week. Therefore technically I have fulfilled the reason for my redundancy in the first place.

But in a nutshell what I am after is, how should I approach this with my employer and do I have a strong case for claiming 1. all of my redundancy 2. Part of it 3. None at all

    No such thing as "voluntary redundancy". It looks like you are resigning before the end of your contract and your employer is agreeing to release you early
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Indeed.

    It is a commonly used phrase but as you say it doesn't really exist.

    OP, you and your employer have reached a mutual agreement to leave on a certain date in exchange for an agreed sum.

    You can of course resign sooner (subject to giving your contracted notice) but if you do so you give up whatever amount they had agreed to pay you..

    You can ask your employer if they will agree to different terms but they don't have to.

    If you've now resigned why would they give you money for losing your job? You've now given up your job rather than 'lost' it.
    Don't listen to me, I'm no expert!
