PIP....No points at all....

Looks like tha mandatory route first, then the appeals process.

Friend got their PIP refusal letter today.

Fortunately I was there at the interview, it talks about the muscular skeleton exam ( well something like that) which is amazing as there wasn't an examination, another " observation" was the client didn't appear anxious or stressed? They burst into tears and the HP said they would do the interview quick and no examination to avoid further stress....

Good eye contact ? , my friend looked at the floor for most of the interview.

There was no report or anything enclosed with the letter, just a score sheet and about half a page on why it was refused quoting these lies and assumptions.


Now to find out how to write this mandatory letter thing, then get ready for a fight....lol
No two ways about this one: Anything Free is not a Basic Right..it had to be earned...by someone, somewhere

    They never send a copy of the report with the decision, you have to request it specially.

    To write the request for a mandatory reconsideration you need to google 'PIP descriptors' and give detailed reasons, with examples, of why you think you get particular points. You have 28 days to get the request to them, so start doing that now. If you have extra medical evidence send that off with it, but don't delay writing the letter if you need time to gather evidence. Put in the letter that you'll be sending more information and they should give you time to send it in.

    Very few MRs succeed, although it's not unheard of, so be prepared to go to Tribunal for a full appeal.

    It seems so often to be the norm that a claim is refused at the first stage and at the MR stage. I guess it is hoped that claimants will be worried about taking it to Tribunal and will back down.

    I've said many times, the Tribunal service should have the ability to impose fines on the DWP in cases where they think it was clear an award should have been made at the first stage.

    As someone who just got turned down for ESA I was shocked at the lies told. I apparently had an eye exam, told them I spend all day in front of the TV and I suffered no pain. Well I didn't get an eye test said nothing about sitting in front of the TV and was in obvious pain the whole interview. It's been a real eye opener this process, how can it be allowed to lie like this?

    There does appear to be a case for having the interviews video recorded, as this would serve a two-fold purpose: 1)catch out lying interviewers 2) be used as evidence against benefit thieves who play up for the interview then 'recover' on the way home. The latter wouldn't be able to deny a claim to have certain difficulties , which they later are shown not to have.

    I am in same boat, apparently my walking stick and the scooter she walked pass are invisable and I use no aids, and the letters from specialists to my gp regarding bouts of paralysis are invisable also because they did not witness it during assesment it does not happen, and I have earing aids - which I do not !

    Surely this was not just a mistake. If it is shown that the person has lied on what is presumably an official government document then surely some action can be taken against them?

    Time and time again they blatenly lie and get away with it, they claim I have hearing aids yet I do not but my electric scooter and wheelchair appear to be invisbale or not classed as aids to mobilty.
