Garage Liable for car hire? Missed holiday.

I had a new car part fitted 4 weeks ago, 2 weeks after on our way on holiday the car part broke and we were left stranded. After RAC and towed back home I had to get a hire car so we could get to our holiday. It was bank holiday and the garage was shut where I had the part done. In the end we lost a days holiday and it cost me £200 for the car hire. Are the garage liable for the car hire costs???

    No. They are liable for replacing the prematurely failed part.

    Didn't either your travel insurance or breakdown cover provide a hire car?

  • Did the part fail or did poor fitting of the part cause it to fail?

    OP has also posted the exact same question in Consumer Rights. Much the same answers have been given.

    @arcon5 ... the answer is No, regardless of why it failed. Consequential losses are highly unlikely to be recoverable. (OP could try a court claim for such losses, but the chances of being successful are slim). :)

    And has not been back to answer any further questions, and probably won't be until there is someone telling him what he wants to hear.

    They said the part failed but hard to prove otherwise I guess. Thanks for the responses.

    If the part failed due to poor workmanship there is no reason consequential losses shouldn't be recoverable! Why would you think otherwise?

    If it seizes and shreds the belt, which drives other ancillaries, then - yep. The belt run may well not allow for the compressor to be bypassed.
