Why could you not still attend the event and then drive home or set off early next morning if the event was the next day.
A 31/2 hour drive may not have been your preference but would have been doable if you wanted to attend the event.0 -

If he had known he didn't have accommodation when he arrived he wouldn't have gone so why will this cost not be considered?
The park had chance to inform him of potential issues as he had contacted them earlier in the day.
Thank you for your reply
Yes this could have been prevented by telling me prior to arrival or sorting out the problem.0 -

The drive would not have been 3 and a half hours the next day.

You may find that as you have accepted the remedy of a refund you will get nowhere with a claim for anything else.
I work in retail and if something goes wrong with an item that causes damage if the customer accepts a replacment or refund then thats the end of it im afraid .This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Unfortunately I have neither of the above!
They are a big company, I really want to name and shame them.
It's a shame because it would be perfect for this.
You don't have a family member who could do this for you who does?0 -
One other question, you've not described exactly what the reason was you could get in? Also, what time you arrived.0

To determine whether a cost is a loss caused by a breach, you apply the but for test - namely, would they have incurred those costs if the breach didnt happen? If yes, its not a loss caused by the breach. If no then it is. They would have still paid fuel if the contract was performed correctly so its not a loss caused by the breach.
However OP should have a claim for loss of enjoyment/stress/inconvenience - normally it cannot be claimed but courts have said these types of contract are the exception to the rule as the nature of the contract itself is for entertainment & enjoyment. You keep using that word. Is there any consideration for the fact that OP could have instead sourced alternative accommodation in order to attend the venue?0
