Fixtures and contents form

Hi all,

I am FTB and received the fittings and contents form. The vendor has said the sofa is included with the sale price. I already have my own sofas from my rented flat which I want to take with me. Can I let her know that she needs to take/dispose her sofa via my solicitors?

Thanks in advance for any advice.

    It might be sensible to do this via the EA in the first instance. The EA can phone the seller and hopefully get this informally agreed.

    Then you tell your solicitor to get formal confirmation of what you've agreed.



    An EA could get you a response in 15 minutes with a couple of phone calls. Getting a response via solicitors could take a couple of weeks. If there's going to be an 'argument' about it, it's best to start getting it sorted now, rather than starting in two weeks time.

    (But TBH, in this case I can't see an argument developing.)

    Thanks edddy. I will call the EA on Monday and speak to him about the sofa being removed first.

    My solicitors have asked me to confirm whether I want to buy some of the items the vendor is offering to sell so will mention the sofa when I respond back.

    It's all open to negotiation at this stage. The vendor could insist you HAVE to buy the sofa if you want the house, and you could insist you will only buy it if they leave the cat....

    So best done as polite negotiation through their estate agent, who will be faster and more flexible than your solicitor. Then, when agreement is reached, formalise through your solicitor.

  • She might also just leave it anyway - it cost us £240 to dump all the junk left by our sellers, including two mattresses, a broken washing machine and a torn sofabed. Then they didn't actually leave everything on the F&F form. Our solicitors told us we could take them to court for the cost of the removal etc. and that we would win, but we decided it was unlikely we'd ever see the money. We turn away at least one bailiff/month so I think we were right!

    If you think she may end up leaving it, or argues, you could always reduce your offer by whatever it would cost you to dispose of it.

    Tell the agent to ask if they can please remove the sofa.

    Worst case scenario, unless it is a real horrible sofa you can advertise it on Freecycle/Freegle and get someone to pick it up for free.
    British Heart Foundation also do free collection of furniture in some places (also councils might do this for a few quid).

    I know there is always a chance of the vendor leaving items in the house. I remember seeing a thread recently about this.
