tax credit madness! - forum adviser needed

i spilt with my DD father when she was only 5 months old (2003) he left the house we rented from my dad and went living at his mothers, in 2004 my dad who owned my house said he was selling the house he agreed to sell it to myself, i could not rise the amount on just my wage so my ex said as a financial ivestment he would co-own the house on a morgage but not live there, we got a mortgage and a bit extra (cause dad sold it me cheap) my ex and i agreed to have the extra money paid into a joint account to have repairs done to the house, so we opened up a joint account and by this between us thru this bank account we had work done on the house, we got the house cheap so was quids in when we sell in the future, still my ex didnt live with us he seen it as a good investment, he paid the mortgage and so didnt give child support which we agreed it worked out great for both of us, in 2005 i had a (let say drunken meeting) with my ex and got talking which then led to my 2nd child DS who was born in the 2006, still i told the ex but we still not together i was pleased to have another child especially to the same father but it made things complicated, i rang the tax credits to advice i was leaving the counrty on a 3and half week holiday wondering if this would affect my claim they said no, i advised them of my sons birth which they didnt even registered and instead my claim was cancelled - i received no money from june 06 - april 07 and they said i was overpaid by £800, i appealed and lost so i re-appealed and was told that they owed me, they paid me in the april 07, recently i got a letter off them saying it was a mistake and could they meet to discuss, i had no problem with that so they came to my house, they said that my ex was registered on the electrol roll at my address and that he had applied for a loan last year at the same address and also that we had a joint bank account, i couldnt believe this, they had done a experian check but hey yes he doesnt live here but i dont know whats hes doing he stays at mine to look after the kids and i go away! they now think that i made a false claim for working tax and child tax credit and that he was living at my address but he wasnt, ive shown them my bank statements and child care receipts everything, what am i to do? they say it doesnt look good and that i should admit he was living me! but im not doing that cause he wasnt, i dont know what to do ive made an appointment with my MP next week because this isnt fair, if they think he lived here then why they not got any surveilance? because its not true!! please help:money:

  • Hi jjen,

    Making an appointment with your MP is a good thing, but in the meantime, I'd advise going to see the Citizens Advice Bureau for their advice as well. MPs are very good for backing you up and compelling people to answer questions when they'd normally fob you off because you're only a little person, but the CAB can give you more practical advice.

    Try not to worry and good luck.

    You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)
  • Can you and your ex provide evidence that you maintain separate households ? for example does he have a rent agreement for another address,bills in his name etc, does he have a car - what address is it registered at ? Does your ex have a sole bank account or credit cards registered at his present address ? what address does he use at his doctors surgery ? what address do his employers have for him ?
    You need to get together as much evidence as possible that proves you maintain separate households
