Gap Insurance

Hi
In 2011 I pulled out in front of a car and caused a collision, I was at fault and the third party claimed on my insurance, but I did not have Gap insurance and had to pay what was outstanding on my finance.
Now! in 2013 my wife brought a car on finance and the salesman asked about Gap insurance? I advised my wife to take it as what happened to me 2 years earlier. the salesman said she was covered from the first instalment to the last, that worked out a finance term for the car for 5 years.
Now two weeks ago a young man ran into the back of car the as I was driving it, ( I am the named driver). and the car is beyond economical repair, I checked the paperwork and the final invoice from the sale of the car stated that Gap insurance was paid to the finance company. I have spoken to the dealer and he has checked that we are only insured for Gap for 3 years from March 2013 to March 2016. my wife and I do not remember what so ever the salesman explaining that the Gap insurance only lasted 3 years, so I have made a complaint to the Ombudsman in my wife's name and the Finance company have to respond within 8 weeks.
The question is- has anyone else had this and if so what was the outcome?

Hi
Thanks for the advise but on this occasion I will let the Ombudsman decide?
I will post a comment of the outcome after the final decision.

The ombudsman will look at your paperwork and will decide from there. If it's written in the T&C, then they are unlikely to side with you as you've had the info the whole time. (This is why you get 14 days cooling off period - to read the terms of the contract).0
