hospital issued PCN-help please

Hi all,
I need some advice about the driver who is a staff at NHS hospital, recieved a PCN form the trust. She had applied for the parking permit , but had been told that there is 6 months waiting list for it currently. But considering driver's safety & for the safety of the car , doing late night shifts etc, the driver has been parking in the hospital grounds and ended up with the PCN. It states pay the trust £15 within 7days , £30 before 14 days or £60 within 28 days. It also states details will be passed onto third party who would pursue for charges, if not paid within 28 days. Please help.The contravention is no permit displayed.

Also when the driver applied for the parking permit, she had given them her car registration, so I'm not sure if she has any grounds to fight this ticket.Any suggestions much appreciated. TIA

    is this done "in house" ? if so , which trust is it and are they BPA members ?

    if not who is the PPC ?

    It is bradford teaching hospital.It is done in house i think, as long as it is paid within 28days it can be taken to hospital cashier's office and there is also a hospital security staff's name & email details to contact. But i think as per the PCN if it goes over 28days then they pass it onto 3rd party.

    Bradford Teaching Hospital is not a member of an ATA, so they can't utilise that route to acquire your details from the DVLA.

    But as the 'landholder' (but doubts have been raised in regard to NHS Trust properties as to whether it is public land) they can apply via a paper request to the DVLA. Whether they will or won't, no one here is likely to be able to predict.

    They have your vehicle VRM details through your application for the permit. Whether they can use these raises Data Protection issues. You need to be awake to the possibility of them refusing you a permit in the longer term. No easy answer for you, but maybe best advice is to see what their next move is.

    Others may wish to chip in, so don't rush things.

    I'm contemplating on whether to pay up the £15 , as it will go upto £60 soon or should I wait and see what happens :sad::sad:

    I would see what happens myself. A third party will be debt collectors who have no powers other than to send you free bog paper or firelighters.

    If the hospital takes this further they have to make a paper application to the DVLA to get the keeper details. They should have an appeal system and one of the appeal points would be frustration of contract as you can't get a permit for parking for six months, so a PCN is the result of an unfair contract.
    Other appeal points will be available.

    Have you complained to the powers that be, and involved your union rep yet?

    Thanks fruitcake. The driver hasn't complained yet but is aware that the trust has had several staff complaints about the waiting times for the car permit, as they are forcing staff to park on side roads, etc around the hospital that are poorly lit putting staff's safety at risk !!

    I was thinking about contacting the security staff detail(email/phone) provided on PCN , to see if they would cancel it, as the driver is a new member of staff(unaware of policies)..but I didn't want them to use the phonecall to obtain driver details.

    Could you write in the third person as keeper saying the driver is an employee/trainee etcetera and had permission to use your car, but you have yet to receive a permit? Or, you were an occupant of your car and the driver is an employee ...
