Rant about Landlord - being evicted

    Hi MSM,

    Perhaps a little long. I'd go more along the lines of: "Property viewed Saturday wasn't a goer, but more viewings booked for next week. Will do my best to be out by 31/10 as I realise your mum wishes to move in, and will keep in touch."

    Keep your knowledge of your right to the 2 months' notice up your sleeve for now. You may not need it anyway.

    Agreed - I would not get into the "two months notice" thing by text anyway - that's something you really need to talk to her or communicate in a letter, as tone of texts can be misinterpreted so easily and she could take it the wrong way.

    You shouldn't do it by text anyway incase she tries to keep your deposit.

    Even if you do it verbally follow it up with a letter (in the letter make it clear you are doing a favour and she is breaking the law) so if she keeps your deposit and you have to go to court then it wouldn't be looked on very favourably.
    I'm not cynical I'm realistic :p

    odds are if you stay on it will probably get nasty anyway so i wouldnt pay the last months rent just in case, tell her that you have lost confidence in her after previous shinanigans, to take the last month out of your deposit and youll pay any reasonable deductions once detailed on your vacation of the place.

    We have definately not been served with an earlier section 21. I make a point of never signing anything without reading it and am quite used to legal documents/contracts/forms with my job so don't think she could have slipped it past me!

    It is not necessary for the tenant to sign the S21. That is only asked for as proof of service but the signature isn't actually required, or even expected.

    It beggars belief that the landlady does not know two months written notice is required. I mean would most here do the tiniest bit of research if they were going to hand an asset worth hundreds of thousands over to a complete stranger?!!! This is why I suspect the landlady may think notice has already been served.

    I would not write this, it raises expectations too much and will only cause more resentment if those expectations are not met. MSM needs to put his exams first, this is an important part of his career.

    I would raise the point about notice but if MSM wants more time then wait till after the 28th to gain another month.

    It makes me :mad: the way some landlords treat their tenants, thinking they are just there to pay the rent just for the landlord's convienence but with no concern about the disruption caused to the tenant's life by having to move at the drop of a hat!
  • just to update. we politely stood our ground and told landlady it wasn't possible to move out when she wanted.

    She then served us a Section 21 notice giving date of possesion as 13 November (2 months after the first telephone phone call)

    We know this is still not correct and should have been allowed up until the 27 November but have found a house to let now which is availble from the 2nd week in novermber- so it actually suits us fine.

    I'm concentrating on exams now, and then have 2 week period to organise the move afterwards.
