so me and my partner had to move out of our house that we rented privately, im on esa and pip and she gets carers for looking after me, we only moved out yesterday and have not told the landlord yet as it was very quick because of my mental health it was a place we could not live because of constant trouble with the neighbours, we have moved our stuff into our parents houses like some at my parents and some stuff in her parenets, and they have said we can stay over at there houses but only for a week at a time so there money doesnt get messed up, but with us not having anywere to get a mail sent as we cant say we are living at there houses what do we do about our benifits? we cant get a council house until we have payed the money back we need to pay, not our fault was over payement to a housing assoication but we owe money and can only pay so much weekly, so cant even save for a bond and deposit for a house until we have payed that back as every penny goes towards that, can anyone help please will the dwp send our letters to a parents house without it messing up there money and things? or is our money going to get stopped all together? or should we say we still live at the address we are renting and just go back for the mail every week? but the only proplem with that is the neighbours seen us move so no doubt the windows and things would have been put through

The only way would go to the councils homeless office and try and see if they will put you in a hostel or temporary accommodation, But you say you just moved out of your "old" house and not told the landlord the council might not be so accommodating for making yourself homeless and it appears you're aware how it's happened so you can't really use mental health as a way to get the council to help....

It sounds like you've got several layers to your problem.

You really need to let your landlord know you've left. You'll have to keep paying rent so you need to give your notice straightaway. You also don't want to end up owing for broken windows and any other damage that has been done. Plus you need your deposit back.

You can have a 'care of' address for your benefits, this can be a friend or relative. If you're clear that it's a care of and you're not living there then it shouldn't affect anyone's benefits.

For what to do about where to live now, that's complicated. Did you leave your Housing Association place because you wanted to or were you evicted? It might affect what help your council is obliged to give you.

Is there really no way you can move back into the old place even for a few weeks? Keeping your landlord on side for a reference would be a big help. I know it's hard - someone was shot outside my flat a few weeks ago and I already have mental health problems which have been made worse. I also have a drug dealer living next door, and people knock on my door thinking it's his. So I know about bad neighbours! At the moment though you have somewhere to live and so you're intentionally homeless, which really limits the help available.

Have you reported the problems with your neighbour to the police or council anti social behaviour team?
Unless I say otherwise 'you' means the general you not you specifically.
  • hi, and theres no way we can move back in there as i had to be locked in the house the night before we left to stop me from going out and doing something stupid, as i loose my patience really quick im a danger to myself so someone had to be with me all the time to make sure i dont do anything stupid to myself or others, we are fine to stay at diffrent family members for the next 2 months tops then we will have money for a deposit and things, we had so many proplems there and we were only there two months, we didnt have any lights, no smoke alarm was fitted until day before we moved out, the heating system was from the 1970s and didnt heat up the flat, there was no gas just electric, the cooker was also from the 1970s and we couldnt get a cooker until they removed that one, wich still hasnt been removed yet, so we had to live on microwave food, the front door window was smashed when we moved in they said it would be sorted and a new door put in the next morning we waited 4 weeks before it was sorted.

You are planning to notify the council that you're no longer living there, and stopping your housing benefit at some point then?
What notice do you need to give your landlord ?
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.
  • You will need to do two things as soon as possible.

You need to let the landlord know that you have left. At the moment you are still responsible for paying him rent. You are already having money troubles, not paying him his rent will only add to your problems.

Then you need to go to the Housing Office at the council. There is no guarantee that they will help you, but they should be the first place you go for help. Your main problem will be that you chose to leave your last place. The council may see this as proof that you intentionally made yourself homeless.

Make sure that you tell the Housing Officer about your mental-health issues - it is possible that you will be classed as 'vulnerable' because of this which may help the to find you somewhere to live.

Be prepared for the fact that you may not be rehoused immediately. You may be offered temporary accommodation whilst the council look at your situation. It is possible that you and your partner may not be housed together.

You are aware of your on mental health issues, and that you lose your patience quickly. You might like to have someone go with you to the council...someone to help you stay calm. It will not help your case if you lose patience with the Housing Officer. Do you have a care-worker or assigned social-worker who could go with you?
  • Would your parents allow you to stay longer if you covered any non dependent deductions? This shouldn't be difficult with the income you have coming in, and would still be cheaper than having your own place.

Your partner can go with you to the council if you need support.
