Gravel car park

Hi, I have recently got a ticket for parking 'causing an obstruction' in a gravel hospital staff car park where there are no marked spaces. The photos the parking attendant took are simply of my car, showing no obstruction. I admit, I was not parking in the general 'pattern' that staff seem to park in, but is there anything that defines 'parking causing an obstructIon'? The company who issued the parking ticket was UKPC. I have appealed to them but it was declined. Should I just pay up or is this worth ignoring or fighting against?

if this was in england or wales they should have issued a popla code

in which case draft a popla appeal

did you "out" the driver ?

or was it a keeper appeal ? (without outing the driver ?)

    DoH rules are here

What did the appeal say and did you name the driver?

Same advice as here, you have 28 days to appeal to POPLA but do not just write it about 'what happened and why' (you will lose):

Search the forum for 'UKPC POPLA' and do not ignore this, let's try to win it at POPLA. It is a shame to read two posts from people with UKPC Hospital PCNs, who did not come here earlier and (presumably) didn't find or use the template appeal from the NEWBIES thread, from the registered keeper.

As coupon-mad says ..... hope you appealed as the keeper and not the driver.

UKPC will of course reject your appeal, they just want your money, they are a disgusting company.

In the past, they have been known to fake pictures to extort money and they use wardens to hide behing objects waiting to trap you.

You have an interesting case in that the picture they took, did not show an obstruction which they claim ?

There are no defined parking space lines so to a motorist there is no direction to follow.

What about the signs in the gravel car park, they will list what you must do.

Firstly, it is important that you tell us what you said to UKPC, please let us know
  • Thank you for your responses. I do have a POPLA reference number now so I shall start to draft a second appeal.
I appealed as a keeper without stating anything about who was the driver. in terms of the parking signs/instructions, this is all their guidance:

" If double parked or causing an obstruction in this areas contact details must be clearly displayed at all times and able to return to your vehicle immediately. No double parking after 4pm."

Surely if there are no lines or spaces marked and no definitive explanation on the sign then it is impossible to define what 'causing an obstruction' or 'double parking' is?
  • Same here with obstruction, that's one half of a contravention Excel are trying to do me for, photos show a fence and another car to side. They have nothing as far as I can see, reason I'm fighting. Good luck with it!

It used to be said that a car can be driven on a road, but once it stops, it becomes an obstruction. On that basis, were all the cars parked causing an obstruction ?
Complete your popla appeal and let ukpc explain their definition of an obstruction and also show their evidence of how your vehicle was contravening their rules.

As well as searching for 'UKPC POPLA' also look at the 'POPLA Decisions' sticky posts at the end, from today and yesterday where we are starting to put together a few template appeal points for POPLA that can be used. More will be added and updated shortly so no rush, you have 28 days.
