Council PCN Issued in Less Than 3 Minutes

Hi all,

Firstly I want to thank the regular users who usually are at hand to advise. I still use this forum when I get private parking tickets or when friends get them.

However on this occasion my mother seems to have received a PCN under being "Parked without payment of the parking charge" from Barnet London Borough Council.

The car was "observed from 15:38 to 15:41".

The penalty charge was given at a location where payment can only be made via phone or text. Upon parking in the bay, my mother got out the car to check how she can make payment. Its worth to note she has never parked in a bay where payment can only be made via phone or text. So while it took her a few moments to figure this out and go get her phone little did she know there was someone observing the car. She continued on and got her mobile out from the car and started making the phone call. As she was on the phone the wonderful gentleman who calls himself a "Civil Enforcement Officer" placed a ticket on the car. She immediately questioned what he was doing but he didn't reply to her. My mum pleaded that she was making payment on her phone but he refused to listen and kept stating the the parking ticket has been issued and nothing can be done.

This person gave less than 3 minutes for a lady who's not very good with technology to park, see the sign, get back in the car, get the mobile out of her bag, make the call than attempt to register her credit card. I called the exact same number she rang and it took me over 1 Minute just to get to the first step of setting up an account.

I would appreciate any input since the 10 minute rule does not apply here if I'm correct?

Totally agree, Ralph-y, pepipoo are the experts - but samin999, I also agree with the case you plan to make in appeal. She should appeal to the Council on that basis. Expect a rejection because Councils like to dangle the carrot of the discount rather than fold early!

But - if it is rejected - just ignore the kind offer of the discount and await the NTO (assuming she is the owner and it's not a company/lease/hire car). Then start a new thread on pepipoo.com - you register for free but no hotmail addresses! - to show them the NTO, rejection letter and both sides of the PCN.

If you wish you could ask pepipoo for an opinion now, sooner, to see if they say the same as me. I did used to regularly contribute there on this Council tickets forum:

...but I'll cheerfully admit to being a little rusty on Council PCNs, compared to the current regulars. Do be confident that ALMOST ALL (over 90%) of Council PCN appeals on pepipoo are won in the end. I always say with Council PCNs, come back and tell us when pepipoo help you win!

It seems the councils like to cash checks in even if it means being corrupt and robbing you in broad day light.

I will definitely pop over to pepipoo and introduce myself there in hope we can fight this unjust system. Will most definitely let you know what the results are and what pepipoo advise.
