Another rental deposit return question

Evening all.

I've tried a search but not sure if previous threads have covered this.

I completed a tenancy today at the end of 6 months. The landlady came round at midday, and completed a checkout procedure.
She didn't give me anything in writing, so I got her to write a confirmation on my copy of the original tenancy agreement to say she was happy with the condition that the property had been returned to her in, and that the deposit would be returned in full as long as I cleared any utility bills - which I have already arranged to do.

About 30 minutes after I left her at the property, I received an email from her saying that she had found some marks on the garage floor (bare concrete) but she was willing to overlook them - bearing in mind she inspected the garage during the checkout.

Then, about 4 hours after that, I received another email from her saying that she was willing to overlook them on the basis that they would clean off when she tries next weekend, and if they don't come out I will lose part of my deposit to cover the cleaning attempt.

Now, surely if I have left the property in her control, and she has provided written confirmation at the time I left that she was happy with the condition, she has no grounds to withold any of the deposit? And also, as it is a garage is this not fair wear and tear? I will add that the deposit is held by the DPS scheme, but it was too late to contact them by the time she emailed me.

She has also refused to let me reacted to look at the marks, saying that if I did she would call the police as I would be trespassing (I'm a police officer so that would be interesting)
I wasn't sure whether to contact citizens advice as well, or just leave it to the DPS dispute process?

    Use the arbitration process and submit your evidence.

  • Haha, I do get it - unfortunately!

    That's what I was hoping. I'll be ringing DPS first thing in the morning to get the process started (why they don't offer some kind of online service is beyond me), see what they say
