Problem with Check-out

Hi

We moved into our own house last week leaving our rented property. Having given our notice, but still having a month to run, our letting agent noticed we had moved out whilst showing a potential tenant round. We were called and told the tenant wanted to move in ASAP and could we check-out soon, the next day was agreed and we were told we would get the remainder of the months rent back from the day of check-out.

Today, the letting agent has gone back on this, now saying the new tenant cannot move in until later in the month and we won't be getting our months rent back.

I'm wondering where we stand on this, the check-out has happened, therefore we have no access to the property, but the letting agent says we have a contract until the 2nd October and we are still liable for the property.

    Do you have a written agreement with the landlord/agent that they accepted your offer of an Early Surrender of the tenancy?

    Without this, it is your word against theirs as to what precisely ws agreed.

    I suspect the LL/agen will deny it was a firm agreement (indeed, this is likely) ie "if we can re-let, we will accept your ES."

    If however you believe an ES was firmly agreed, to take on place on a given date, you could argue this in court (or the deposit scheme arbitration if return of your deposit becomes the issue). It would then be up to the court who they believed.
