    31 mins is just like 3JD08399 ParkingEye v Ms X. (Altrincham 17/03/2014) at the Fistral Beach car park along the road. Case already linked as Blogged by the Prankster and of course, IvorPEcheque who has just replied above, is VERY familiar with it!

    No. It talks about the release of information if you believe your details were obtained fraudulently but no protections of freedoms act.
    Are you sure there is nothing lower down, under that, talking about 29 days and keeper liability? Or is there a white space (where wording has been removed, near the end of page one, a blank gap?) and is the 'date issued' (top right info) more than 14 days after the date of event? Why the delay if so, is this a hire/company car and PE wrote to them first?

    This is winnable if this is a non-POFA PCN, as we are describing, and you can win this at POPLA using an appeal like the one linked here:

    It sounds like the same Fistral beach car park.
    Are you sure there is nothing lower down, under that, talking about 29 days and keeper liability?

    "All appeals and complaints must be put in writing and should be forwarded to one of the addresses below. All appeals must be received within 28 days from the date of our initial correspondence."

    I can't see anything about keeper liability. There doesn't appear to be and blanked out wording.

    Date of event is 11/8/16
    Date of letter is 25/8/16

    I'll see if I can get a scan of the letter.

    I doubt it as the fistral beach car park is now SMART PARKING and yours is PARKING EYE

    fistral was PE but not any more

    They sent it too late for keeper liability! GOOD. You will not notice 'blanked out wording' just a blank white bit at the bottom of page one. For POPLA, you can use the same sort of appeal as already mentioned - SPECIFICALLY with the wording mentioned - and with that, you should win.

    Like we said, a big blank space at the bottom of the wording. Like we said, not a POFA PCN. Like we said, when you get a POPLA code, simply use and of course, adapt and edit to make sense, the example POPLA appeal already linked for you. You are lucky to have one that isn't a POFA version! A winning ticket!!

    They cannot have 'issued' that PCN on Sunday 25th August as there is no Royal Mail delivery/collection that day and PE use iMail or similar, which only delivers on weekdays. 26th was a Bank Holiday so the very soonest that could have even been put in the post was Tues 27th (and we known it wasn't - but that doesn't matter). That PCN sent too late for POFA which is why PE have used a non-POFA worded version (they are not as stupid as some PPCs).

    The keeper cannot be held liable - so you appeal as keeper.

    Should be an easy win as long as you do not miss the new POPLA appeal point, as already stressed and shown in the linked thread.

    Start by sending the usual BPA template online to PE, calling yourself the registered keeper, as per the NEWBIES thread advice.

    Following my appeal via their website PE have sent me another PCN. imgur.com/a/IQOvv. And they've added a bit to the bottom. Do I need to take any action due this new letter?
