Can my landlord recent my room while I am in contract?

Hello

Can you please let me know where I stand and allowed my money back for 1 week.

I rented a room for 2 months and the contract will finish by the 9th September. In the middle of my contract, I found a new job so had to leave my room earlier. I paid the full rent until 9th September and informed the landlord that if some one comes earlier she repays me back as i paid the rent upfront which she agreed. The room was free for 2 weeks but she let the room to a person from couple of days back.

I asked her since the room will be occupied for atleast a week by another person I am entitled my money for the last one week. She now says she won't pay refund for one week.

Where do I stand? If I am entitled how do I get my money back for the last week. I know its not much but I am keen to get what I am entitled.

Any advice on how to proceed?

    Yes it sounds like it, small claims court

    the only way is to go to court
    1. send a letter before action giving her 7 days to pay you the money
    2. if no money received by day 8 start legal proceedings in the small claims court

    of course the court will decide the case based on the evidence you submit, so:
    - was the agreement that she would refund a portion of the rent you'd already paid if the room was re-let given in writing, or was that just verbal?
    - when you moved out did she agree in writing to release you from the tenancy (it is called "early surrender")

    I don't think there was any early surrender. Tenant paid up til conclusion
  • I suspect the OP was a lodger rather than a tenant - just saying!

    Not really enough info provided yet (see Qs above), but to be honest, we're talking about a week? Is it worth the agro? You agreed to pay for 2 months; you paid for 2 months...

    Is there a deposit involved?

    The agreement to return money was verbal but the landlord clearly acknowledges in the text msg that she do not want to return money because it is only a week.

    No early surrender involved.

    Deposit was returned

    I have AST agreement between myself and landlords which shows the expiry is 09/09/2016.

    An AST is for a minimum of six months, and would not apply to a situation where you are renting a room in someone's home.
  • Hi Voyager, thanks for reply. The landlord herself provided me the AST. Just to clarify, the landlord don't live there. The rooms in the house are rented out individually to students and professionals.
