    Indeed. Some people are wrong.
    It would be recorded as a fail and as I agree would be illegal to drive.

    It wouldn't necessarily be illegal to drive. There are many fail points which do not render a car unroadworthy - lights in daytime; seatbelts on unoccupied seats; towbar wiring without a trailer; and many others. And, of course, the fault may have been rectified but the car not retested.

    And that forgets that an unroadworthy car is still illegal even if the unroadworthiness hasn't been pointed out by a tester.

    The MOT certificate is quite explicit in breaking the link between it and roadworthiness - and that goes both ways. But the simple fact remains that, if there is an MOT certificate which has not yet expired - there is no lack-of-MOT offence being committed. No matter how badly a subsequent test may have been failed.

    According to VOSA old MOT remains valid but plod would see both a fail and pass and likely to check the part that's failed been rectified by way of producer or similar? or if its involved in an accident?

    Staying off topic for a minute, the police would just see that there's a current valid MOT because that's all that matters from their POV.

    .... When I asked the seller if they would put a new mot on the car they said they wouldn't be able to as the earliest an mot can be done is a month before the due date. Now I know you can put a mot on at anytime .......
    Maybe the vendor is ignorant of the "rules" about this.

    As others have said either move on or offer him some extra if it comes with 12 months to at least cover the MOT fee.

    I've checked the previous mot's online and the car has never failed a mot or had any advisories. When I asked the seller if they would put a new mot on the car they said they wouldn't be able to as the earliest an mot can be done is a month before the due date.     you can do daily mot's if you were so inclined to do.. however the month before thing is to do with maintaining the original test anniversary.
    You can put the car in for MOT at anytime
