Previous employer imposing parking fine.!

Good afternoon everyone.! Having some trouble with a previous employer and really need some advice and help. I started with the company on 14/03/16 and ended my employment on 27/05/16 due to being treated by contractors and having no backup from senior management I felt I had no choice to leave using my accrued holidays as my notice.

Today Iv recieced a letter through the door saying an invoice for £86 is overdue and if not paid within 7days it will be passed to the legal department and will incur costs for a parking fine on the company car. The invoice is dated for 21/06/2016 but thi is the first letter received.

I had no notice on my windscreen so of course I contest this but they have clearly already paid the fine. In my contract of employment it did state I was responsible for any fine but find this funny they are trying to charge me without providing proof also that they are chasing me for this so late after and already threatening to send this legal without giving me notice.!

Yes my contract did state I am responsible but I could argue my contract was nil and void for not providing a safe place to work thus the fine is not my responsibility ??

Dose anyone have any advice??

  • Just to add it was a lease car I was provided with. I'm going to attempt to find my contract but feel I may have put this in the bin after I left

    Who was the lease company?

    Was this a real PENALTY Charge Notice or an invoice, a PARKING Charge Notice?

    If the latter then the lease T&Cs almost certainly do NOT allow them to pay it and then charge you for it (plus an admin fee no doubt). The lease company are probably BVRLA members, so they should be following the BVRLA's Memorandum of Understanding regarding parking charges.

    Iv not got a clue this is the first I'm aware of said fine. I'm unsure if the Admin fee is from my previous employer or the hire company.

    The invoice from said employer says.

    Penalty charge - parking ticket.

    To:

    Leeds council - parking Ticket not paid, penalty charge ref with the time date and location.

    £50

    Administration Fee

    £30 + vat total £36

    Total £86.

    Settle invoice by return.

    It is accompanied by a letter saying

    Outstanding invoice.

    According to our records, we do not appear to have received payment of the above invoice.

    As you can appreciate this is not overdue can you send payment by return.

    If payment is not received within the next 7 days this will be passed to our legal department, which will then incur costs.

  • So its a council ticket that Global have paid for you but have not given you the chance to appeal. You definitely need to dig out the T&C's for your hire.

    As it is a Council PCN you probably have no comeback as penalties from 'authorities' is most likely in the terms, as will be that huge admin fee.

    A car owner IS liable (not the driver) and so the owner can just pay when they get an NTO in the post - and that's what they've done.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
