Can you complete on a Friday but move on the Saturday

I'm going through a very stressful move (we started the process in January and accepted an offer a week later and had ouroffer in on the property we wanted accepted)

Our seller wants to complete next Friday but we can't move out of our house until the Saturday (the one and only day we can't move is that friday so it typical!) Our buyer is only buying so he doesn't have to vacate his property due to a sale.

has anyone else been in this position and asked if they can stay in the property and move on the saturday??? If you have was it a pain? I have visions of the new owner turning up and turfing us out even though we made an agreement.

Also our new mortgage is with Northern Rock so thats a little worrying!

I would appreciate any advice!:rotfl:

    This happens all the time. You can't complete on a Saturday, cos the banks are closed, so if you want to move at a weekend it has to be friday.

    Get the estate agent to contact the buyer and explain the situation - or contact them yourself.

  • When you sell you have contracted to vacate the property on the day of completion, if you move out a day later you will be in breach of contract and your buyer can try and claim interest as technically you won't have completed.

    If I was your buyer i'd be a bit miffed if I had paid money for a property yet couldn't get keys on the same day.

    It's probably worth negotiating the date with the seller, you can complete on any working day it does not have to be a Friday.

    Hi Hips - what you say is absolutely correct, however any contract can be varied with the agreement of the parties. In practice it does happen quite often that people complete on Friday but agree to move on Saturday.

    Of course if OP stayed put and refused to allow the buyer to take possession that would be breach of contract. But that is not what is being suggested

  • A buyer's solicitor who is also acting for the lender has a duty to get vacant possession for the lender so can't allow this to happen. If your seller moves out on the Friday, there's no problem but if your buyers' solicitor found out what was happening he might try to stop the money going up the chain. He could refuse to complete unless vacant possession is obtained for his clients and their lender.

    I have heard of buyers who say to people in your position that they are happy to wait until Saturday and then when their solicitor explains it they change their minds!

  • Why don't you move out on the Thursday and stay in B&B or Travelodge for 2 nights, with your house contents stored by the removal company?

  • Well personally I am going to push for completion for the following Monday -

    We are on our third buyer after the initial 2 messed us about by making all the motions to move but never actually ever sorting things out properly - for them it was a bit of buy to let fun so there was no rush for them. Luckily we have found a serious buyer now but the first 2 have eaten up so much money in extra solicitor fees that we have to do the move ourself now without employing a company and the one and only day we can't get any help is that friday (the 4 different people who are helping all have a commitment they can't get out of)

    Richard's reply made my mind up for me - I just needed a bit of fuel added to the embers in my head!

    Thanks all - lets hope in 2 weeks I will be sat in my own very quiet home away from the Chavs I currently live by!
