Surveyor negligence

Quite far from libel compared to some of the other stuff on this forum! I think it's pretty clear that the OP is seeking advice on whether it is negligence, not saying that they actually have been negligent. Besides, I'm not sure what their loss would be - all the big firms are going to make mistakes from time to time, whether or not they actually have in this case.
The post is headed 'SURVEYOR NEGLIGENCE'. That is an accusation of negligence. There is no proof, of negligence, only an accusation. Even an accusation can be damaging to professional reputation and the Surveyor can, and rightly so take action against the OP.Eat vegetables and fear no creditors, rather than eat duck and hide.0 -
phill99,
negligence:- neglect; carelessness - I have not accused Shepherds of negligence but merely sought other peoples opinion on whether I could, based on the facts - one of which being............. the Surveyor on a secondary report acknowledged the true construction was not that as described in the original report.
libel:- publish statement falsely damaging persons reputation ;defame falsely - as above, I have made no false or untrue statements.
Where is it that prevents a member of the public from making an open, honest and true statement to seek advice and public opinion. The law is there to protect everyone and not only large professional companies.0 -
I have not accused Shepherds of negligence
Then you should change the thread title to "Alleged surveyor negligence", or "Has this surveyor been negligent?" or something similar.
At the moment it reads as a statement, that there HAS been negligence by the surveyor. I'm not the only one to think so, as you can see above.
If you can't change the thread title, ask the mods to do so.0 -
Why take the risk when you could still get useful advice on the problem without naming them?
Silly to actively court trouble, don't you think?0 -
I have made no false statements, the facts are as described - I should not feel threatened by accurately and truthfully describing the situation.0

Considering there are other threads here naming housebuilders, banks, law firms, utility companies, landlords, and various other bodies of all sorts of mis-selling, fraud, terrible customer service etc, I'm not sure why the OP here should be expected to tread particularly carefully. It's undoubtedly the case that any firm of surveyors of any substance will have been negligent on various occasions - suggesting that there might be another occasion when they've made a mistake is hardly going to affect their general reputation.0
