Received Judgement for claimant(in default) am I too late

    I will just pay the cowboys and have it off my back.

    You will still have a CCJ only one marked 'satisfied', won't you, unless you are still within the 28 days (EDIT - I SEE YOU SAY YOU ARE).

    A set aside removes the judgment and rewinds it to be defended and won. MIL cases are winnable just with a decent defence.

    I'm not sure what you mean CM? I spoke to the court today and if I pay the £170.80 judgement within the 28 days It will clear the CCJ as though it was never there.

    OK, if you are still within the 28 days and choose to pay the judgment sum, then you are in time (unlike most people who find out about these past the 28 days).

    Don't be surprised if even after you have paid, MIL might try to demand their pretend £90 as well:

    Use the Prankster's version of complaints if this occurs and also complain in writing to your local court about MIL's abuse of process. And your MP, this needs complaints all round and is a shame that this wasn't able to be defended and seen off earlier last month.

    Yes I'm kicking myself now for not acting when the court papers first arrived but I will act if it ever happens again.
    I saw that post on pranksters where MIL were trying to extract more money from the Guy and I have already mentioned to the courts today about the Bailiff letter and they weren't impressed.
    I will certainly report them if they try to claim it from me.

    All this is in county court, judges at this level differ, there is no rule of thumb.
    However, county courts are the lowest court in the UK, can we expect judges to really understand, it seems not, some are on the ball but sadly they are in the minority

    In general, you are dealing with a scam industry which currently the government allows .... Like all of us, you have a voice which is best directed to your MP and in particular Theresa May asking why they allow this scam

    Most judges will have no idea, as they won't have seen a MIL case before at their court.

    Because unfortunately most folks won't put up a fight and just pay them - similar to a street mugging really.
  • In answer to an earlier question of mine, you said "Judgement is dated 25th august". This means that if you pay the judgement amount in full by 21st September, the CCJ is totally removed without a trace.
