Rental deposit - help

Hi,

I have recently moved out of a rented property and into a new one, and there was a slight overlap of rental periods to give us time to clean and tidy up our old house. We went on holiday last week, and had intended to do the last jobs at the house this bank holiday weekend (like mowing the lawn which we knew would have grown and would need a tidy) but we weren't due to do an official "check out" until 31st August.

Whilst we were away I received a text from my landlady to ask if I had booked a carpet cleaner to come in or if she should do it on my behalf whilst I was away, and I agreed that yes she could book on my behalf as I'd run out of time before holiday. However, I had also been sent an email from the letting agents whilst I was away to say the had done an informal check over of the house and they sent a list of bits that needed doing, which consisted mostly of things we had intended to do on our return, and before we handed the keys back. Unfortunately, due to lack of WiFi, I was unable to pick up my emails so I didn't see this email, but on my return to England (and internet) I saw this email and the ones which followed where, between my landlady and the letting agents, they booked contractors to come and mow the lawn, clean a few bits, and remove the bits that were left in the garden.

My question is, are they allowed to charge me for this without my agreement? They only sent an email, didn't try to ring me to get my permission, and I feel a bit cheesed off if they haven't even asked us if we were going to sort these bits out or if they could book people to do it instead. We haven't even handed our keys over yet, and have paid rent up until 31st August, so I feel a bit violated that they booked someone to go and remove our belongings from the garden, on the 28th, without our say so. Is that even legal? Luckily we got back on the 28th and quickly went round to get our belongings before someone else did. Do I have a leg to stand on if I refuse to pay out of my deposit?

    I would first send a letter saying you did not agree to that work and ask why it was done without your consent when your tenancy was still in place, and state you had already arranged for someone to undertake the work before 31 Aug.
