I don't usually post on forums, but I am so angry right now.

I went to pick my mother up from a cruise and was directed to a car park as she wasn't out yet. Having no change, I went over to check other payment options and went for the "text" option. I followed the instructions and sent the text and thought no more of it. Then I received a letter from ParkingEye that I had not paid and they were charging me £100 (reduced to £60 if I paid in 14 days). Luckily I still had the text on my phone, so went through the appeal process, attaching the screenshot of the text as evidence. As I was not trying to avoid payment, I offered to pay the original parking fee (£3 for 45 minutes) as a sign of good faith.

I was told that I would hear in 21 days. When I rang last Thursday, I was told that a letter had gone out. I know that it was a bank holiday but I only received the letter today, rejecting my appeal.

Upset doesn't go far enough! I have now appealed to POPLA. To be honest I am not holding my breath. It could take six to eight weeks for the appeal to be completed, so I will already have missed out on the early payment terms. Not that I want to pay anything more than £3 to these people.

I understand that I have to pay to park in their car park (If I had know the issues I would have just driven round until my mother came out of the terminal). To make it worse, the staff at the Mayflower Cruise terminal were directing people into the car park (are they on a cut?).

Although my mother has said she will pay, I am now in fighting mode, any advise on how to challenge these people will be gratefully appreciated.

    You need to start by having a good read of the Newbies Sticky at the top of this forum - which walks you through the various options left to you.

    Appealing to them/contacting them was a big mistake as you have missed several opportunities for to properly challenge PE and maybe identified yourself as the driver - which just plays into their hands.

    So now you need to concentrate on putting together a strong POPLA appeal and/or explore the possibility of complaining to and getting the cruise operator to cancel on your behalf.

    Oh no. That's terrible news unless you mean you read the forum, did your research and submitted a winning humdinger POPLA appeal.

    Why oh why did you not ask for help first...we know how to win at POPLA and if you appealed in the same knee-jerk weak way, you will lose. Not that you have to pay but why did you rush to appeal to POPLA with seemingly(?) no input from the forum, then come here too late?

    Dare we ask, what did you put in the POPLA boxes?

    Or are we in time to stop you and help? You do not write a POPLA appeal with the 'story of what happened'. They are looking for legal arguments as to why the PCN was not properly given, such as 'no evidence of landowner authority' and 'the registered keeper is not liable as this is not 'relevant land' due to byelaws' (but it sounds like you named the driver...).

    This is ParkingEye, they sue people who lose at POPLA and I am worried you have just thrown away your last chance of getting this cancelled.
