I read it several times and gave up. Then, on second look, I THINK it says that the OP is being asked to come in to work when they have booked holiday, but being paid for a normal working day and losing the days holiday at the same time. Which to me is simple - and the OP has already done it. "I am sorry but I can't work on Thursday because I am on holiday that day". I'm guessing that the OP is on a basic part-time contract, but there is regular extra hours available.

I think it's a bit more complicated that that, sangie, but you could be right. My reading is that despite booking holiday, the OP hasn't been paid what they expected because their employer has reduced the amount of overtime they're due to be paid for and effectively made the holiday into TOIL - (unpaid) Time Off in Lieu.

However, none of us will know unless the OP comes back and clarifies ...

Sorry basically im contracted for 40 hours i usually do 55 a week so i get 15 hours OT, however the times ive had off as holiday have been overlooked when the payroll was submitted by the manager so basically whilst i was only there 3 days one week and did say 16 hours OT in those three days. They havent realised i had two days off and the extra hours ive done in OT, so basically they look at my hours at the end of the week and ive done 40 and not been paid the 56 hours which includes the holiday pay for the 2 days off.

Just put your annual leave in for the days you aren't normally due to work. Id bet it's care work. Even if on paper your working 7 days a week just put your annual leave in for days off

When I worked in retail one of my employers wouldn't allow overtime in a week where you've had holiday, does your contract mention anything like this? If you did work overtime in a holiday week you got paid for the hours worked, the overtime and the hours needed to take your salary up to your contracted hours came out of your holiday allowance.

An example, I wanted a fortnight off starting on a Thursday, on Tuesday the shop flooded and we had to wait for an emergency plumber and someone from the shopping centre management to come.

I was paid 24 hours normal time for Monday, Tuesday and Wednesday, 5 hours overtime for Tuesday waiting on the plumber and 11 hours holiday time.

The policy was to stop people double dipping, artificially inflating their wages by claiming over time and holidays for the same working week.

Last post to me sounds like they were on dodgy ground doing that. Basically they cant afford for us not to do the OT all theyve done is fail to realise that i was off on booked holiday and just looked at the total attended hours at the end of the week.. We get 30 days sick pay a year as well i dont but one or two take the preverbial on that. One was off two weeks on the sick then came back armed with the sicknote from GP and sunburnt to a crisp in the middle of March
