Hi I'm not sure if this is correct section sorry! New poster!
I'm a bit angry and annoyed as I recently did a long distance car part exchange for my wife!
I went for an approved used car from Land Rover dealership! The deal was done on the phone as it was 100 miles away and the salesman agreed to deliver and collect part exchange!
I was honest about part exchange I mentioned it had a scrape on wheel arch and needed a new nitrogen sensor!
I offered to send him pictures!
He gave me a decent part exchange figure after negotiation and I went ahead with the deal! His part exchange offer was in line with what other dealers offered me who had physically seen the car! So i didn't feel he was giving me any extra for this!
Everything goes well car delivered and part exchange taken! All finance sorted and paid for!
24 hours later ( first time driving at night) I realise bulb is blown in new car headlight And approx £45 to fit and replace as whole unit has to come out on these cars!
I contact seller to see if covered under warranty!
At this point he states that the scrape on car is worse then what I mentioned and will cost them £500 to repair and they are looking to possibly recover this!
I'm really upset! I was actually going to leave them a really nice review! As they were really helpful! This has just left a sour taste in my mouth!
Where do I stand? What are my rights as I don't feel like I miss described the car! And I know I could have the repair fixed privately for around £200
Thanks
Pardeep

He at no point mentioned he wanted pictures all he asked was that I have full service history and MOT which I provided!
It's a 2008 1 series with only 40k on the clock! I though they would send this straight to auction!
Is he just trying to claw back extra money?0 -
Did you take pictures of your car, in particular the damage?"Facism arrives as your friend. It will restore your honour, make you feel proud, protect your house, give you a job, clean up the neighbourhood, remind you of how great you once were, clear out the venal and the corrupt, remove anything you feel is unlike you... [it] doesn't walk in saying, "our programme means militias, mass imprisonments, transportations, war and persecution."0

Surely he had the chance to re negotiate or pull out of the deal before he handed over the new vehicle if he wasn't happy with the condition of the trade in. Too late now.0

I doubt a blub will be covered under warranty.
Bit risky doing the deal over the phone to be honest. Same thing with the dealer on a part exchange, I would of thought they would of wanted to see photos of any damage.
Not sure if they can come at you now as the deal/contracts are done.
You really should use full stops rather than exclamation marks to end your sentences.0 -
2 things....
1.) Bulb under warranty? - Not a chance, it's a basic wear & tear item, just like oil & oil filters, they get used, they need to be changed, as long as it was working when you got the car (basically, the car was legal to drive), you have no comeback.
2.) As for them reclaiming this, check your paperwork, does it state they can come back and collect funds from you if the part-ex is not as described, etc? If it's not written anywhere in writing, just ignore them, nothing they can do other than harass you with letters & phone calls,0 -

Sorryabout exclamation marks...frustration on my behalf.
I didn't take any pictures unfortunately...it wasn't the sales person who came to drop and collect the car I think it was just an outsourced driver.
I knew the bulb wouldn't be covered under warranty but it was essentially supplied to me with a faulty bulb....which I have now found out want even a Land Rover bulb but a cheap aftermarket.
I called to see out of goodwill if they could cover this as I have had the car 48 hours and £45 seemed rather steep! (Apparently trim has to be removed to get to bulb unit)
He did say that they can cover cost of bulb but also through this bombshell at me about car not being as described...
I just want to know where I stand legally ?0 -
I've paid for the bulb myself and kept receipt I'm happy to just call an end to this but not sure if they will take any further action.0

They have no case so don't worry about. You described it to the best of your knowledge and they did the deal so alls done and dusted.
They are probably trying to scare you into not making any claim against them for any faults that may pop up.
A light isn't a fault though it's just one of those things, unless something is making it pop prematurely0 -

Why would they. Though they might remember you should you deal with them again in the future.0
