Over line between residents parking and shared area

I would like advice on whether it is worth the risk to appeal my PCN issued in Edinburgh at 10:35 on 23/8/16. I have a valid residents permit zone 5 which was displayed. Parking in the local area is a nightmare and has been getting more difficult for 28 years. Adjacent to the residents section there is a shared area for which you can buy a ticket or park if you have a permit - it is contiguous block of parking sections are only separated by a white line. My crime was apparently to park over that line so I was half in the residents area and half in the shared area. As usual it was the only available space a night when I got home. Often I can't park and must get up and move car into a free space at 7:00 each morning. I had a really bad cold so didn't get up that day.
The sign says "P mon-fri 8:30am-5:30pm Permit Holders 5 or Pay at machine Display Ticket Max stay 4 hours". It's not clear to me if I can even park there for more than 4 hours. I have a small car pug 206 and am unemployed so really can't afford this. Is it worth fighting or should I just pay 60% of my weekly money?

  • Forgot to mention parking fine says "24P not parked correctly within the markings of bay or space". That's what I consider unfair, as I'm allowed to park in either section, not to mention being unaware of this stupid rule.

    Who issued the ticket - the council or a private parking company? If it's a PPC then you must ignore it in Scotland.

    Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate) as they need to see all the small print.

    PePiPoo has an excellent success record in dealing with council tickets.

    So, the issue is that the car was occupying a paid space between 08:30 and 10:35.
    How it got to be there, having a cold and so-on is probably of zero interest to the Council.
    I do hope you do find a way to get this cancelled; sometimes just going through the process can do the trick - I had one overturned because they didn't follow their documented procedure for the appeals response.
