Replacement - with an old item?

I believe the op is saying his original phone was in great condition looking shiny and new, and what it has been replaced with, looks significantly not new or in the same as new condition as his original phone.
I would not be happy to have my newly purchased phone replaced with a faded used version, this would be incredibly unfair, what I would expect is a like for like replacement.0 -

Yes, that's my issue more or less. The replacement looks ok - they inform me it's had a new front and back - but the inside is old. They haven't said how old. If it is going to last as long as a new one, that's ok. But how would I know? I still feel it's unfair. But I wonder what the legal position is? Does anyone know?0 -

Thanks unholyangel. If I have to keep the refurb, I'm glad to know you think it's likely to be a good enough option. (though I still think they owe me a new phone!) A couple of years ago I had a faulty phone, some months old, from Asda, and they sent me a new replacement without a fuss. I was surprised that Virgin sent me a dressed up old phone.0 -

You were too late, by your own admission.had you reported the failure during the first thirty days following the sale you could expect a full refund.
Your original posts seems to say that you didn't do that.0
