Scs law - claim form

Hello all,

You may (or may not) have seen my recent thread regarding SCS Law - In short I had received 2 parking tickets (different days) for parking in a outlet centre and "leaving the site", I fought this with UKPC and requested an SAR requesting all CCTV footage and imagery of the alleged, to which they had none.

NOW - Prior to these tickets (which I have heard nothing about since), I had actually received a parking ticket for staying in the car park for over 4 hours. They do have multiple signs dotted around the car park, however the print is almost so small I cannot read it. I took a photo today and have provided this below. I received a 'Claim Form' today issued by SCS Law regarding this one ticket. I have no idea what to do with regards to fighting it.

The amount claimed: £160.00
Court Fee: £25
Legal Representatives Costs: £50
Total amount: £235.00

The claim states - 'Parking at the site was offered subject to the claimants terms and conditions which were displayed on signage throughout. These terms and conditions were accepted by the driver of the vehicle when they parked at the site ('the agreement'). The driver breached the agreement by parking outside the authorised hours for parking.'

£235 for one ticket is ridiculous and I do not wish to pay it (if helped) - any advice would be appreciated. If worse comes to worse, I will pay, but by small monthly instalments, as this is an option on the claim form - but wondering if they can reject this offer?

Here's the sign, theyre all the same dotted around:

The sums do not add up. Even if they took you to court, (unlikely) and you lost, (even more unlikely), the judge would probably award them £225 tops. You do not pay solicitors or court fees until it has gone to court and you have lost, so, in my opinion this claim is fraudulent.

What is the extra £60 for, is itr for DCAs? That also smells fishy.

They are several letters, mainly from Gan, asking solicitors some very awkward questions about these charges on here and on peppipoo. Search Gan, Gladstones, Miah, BW Law, SCS, and £54.

Complain to the SRA that their claim fraudulent.

It may well scare them off.

The more complaints the SRA receive the better, copy your MP in to the complaint.

So you were forbidden from parking after certain hours. Well that's trespass, read on. UKPC have already been stuffed on this!

These aren't the total silver bullet for you, but they certainly give you the firm base on which you will be fighting your case, should it get to court.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Hi, thanks for the reply.

I don't believe the claim to be fraudulent as I've just logged into Money Claim Online and have entered the claim reference number and have succesfully logged in and located the claim against me.

I'm finding it quite hard to digest all this information, I don't have much time to prepare a defence and wish for this final fine to just disappear due to ongoing issues in my own personal/family life.

The sign states that - £100 parking charge, reduced to £60 if paid in 14 days - additional £60 charge if they refer it to their debt collectors. Would it be ok to agree to a partial payment of £120? Or do you believe this would be rejected. Just want this nightmare over as I need to focus on other things in my life at this current time unfortunately.

start low and work up , maybe £20 to start with , then you might get away with £50 or £60 , but they could refuse and go the whole hog

they are in control of this , not you and usually solicitors get paid regardless, so why should they capitulate, they do this for a living and its a profitable living too

If you're asking about paying a PPC, you're asking the wrong people here. Are you happy to pay a PPC who targets the old, the vulnerable, the hospital patients, the cancer victims - yes indeed?

    http://www.dailymail.co.uk/news/article-2709056/NHS-hospitals-patients-hit-cowboy-parking-wardens.html

Or an outfit that leeches on the back of employees who doctor photographs to grip and squeeze people to part with £100 to swell company coffers and earn employee bonuses to supplement meagre wages?

Or to fund the extravagant lifestyle of the owner and his wife? This is what they've been up to, thanks to people who are too frightened to fight.
Meanwhile, down in Beaconsfield, the Williamses, bosses of UK Parking Control, are evidently doing very nicely, too.

Neighbours say the couple demolished the original house on the plot and had a far grander one built to their taste. They educate their children privately, dress expensively and reputedly spend much time in Spain. ‘He seems a nice enough guy, but it does stick in the throat when you think how he has become a millionaire,’ one neighbour said. ‘It’s off the back of people’s misery.’

The whistleblower Tony Taylor, who exposed the ‘despicable’ practices of some of the company’s staff to the Mail this week, says he resigned in disgust at the dirty tricks wardens under his supervision were ordered to play in order to maximise their ticket quota (and top up their meagre wages with bonus fees).

He says they were told to issue ‘ghost tickets’, where unwarranted parking notices are placed on windscreens and photographed before being removed, so that drivers pull away without even knowing they have received a ticket. They are told to hide in their cars so motorists don’t know they are patrolling.

UK Parking Control says that it has no knowledge of these alleged practices and deny it is company policy.

However, another neighbour claimed that managing director Mr Williams is not forthcoming about being in the car parking game if anyone asks him about his business.

If you're going to pay, that's up to you, but do try to sleep easy. Don't forget, you'll now be marked by them as an easy target, so if they get a chance to come calling again, don't be in the least bit surprised.

Suggest you read their signs very carefully in future.

I do not condone what UKPC do in anyway, I understand they're crooks.
But there's not much I can argue unfortunately other than the writing is too small on the sign. I wouldn't stand well in court in my current situation, and there representative would just argue everything in court as I do not have much to stand.
So please do not act as though I'm ok with with UKPC do, because I don't.
If I knew what to argue and what to say I'd go for it.
