Apologies for interrupting the thread I am new to the site and have done much searching to find it. This may be the most relevant thread.
I am dealing with BW Legal and Excel. Excel are claiming £154 in relation to PCN in which contravention occurred on 21 September 2012. I was not driver at the time and have stated this to BW Legal but I was the registered keeper. They refer me to case Elliott v Loake which I understand some of which is not relevant. They are now threatening County Court proceedings and have offered £114. I do not wish to pay.
If I do not respond are they likely to issue court proceedings and what would be my defence - would it be pre Popla ?

Yes that is pre-POFA (not pre-POPLA, in fact it is - but 'pre POPLA' is irrelevant).
You should read all the threads on here and pepipoo* and keep responding - also complain to your MP. And complain to the CSA and SRA, as shown in detail in LoveNorfolk's thread.
*shedloads here, copy what others are doing. There are several pre-POFA ones and most replies and defences mention that as keeper, you cannot be held liable (of course you can remain silent as to who might have been driving on a random day 4 years ago!):

Also, to echo the advice to the OP - change your username.
There really needs to be a sticky on what information to put on posts - too easy for newbies to unintentionally 'out' themselves to the PPC.0
