Default after settling

Hi there I had a Scottish Protected Trust Deed which ran from 2009 until 2012 and given this is 2016 it is no longer on my credit file and none of the debt associated with it is bar a loan from Lloyds which was included in the Trust Deed . On my credit file this is still marked as default even for July 2016 . I took the loan out in 2008 and it was included in my trust deed but Lloyds have put the default date as 2012 and also not marked it as settler satisfied or anything . Is there any way I can get this removed ASAP ?

Hi there,
Recently went through something similar with my partner, you need to speak to the creditor (Lloyds in this case), as long as the default is settled in full they should have no reason to not remove it.
If you are querying the 6 year rule it is essential that the creditor also has the date of default correct, if you have proof, you can ask them to make sure the started default date is correct and then it should be removed anyway, either way you need to contact the creditor with all the details, they are the only ones who can remove the default in any situation.
Should they be unhelpful, contact the FSA - fsa.gov.uk and progress under the correct tabs0 -
Hi
The guidance from the Information Commissioner’s Office (ICO) says that a default date should not be later than the date an insolvency process such as your trust deed started. The default should therefore no longer show on your credit file.
As safaridan says, you can ask the creditor to correct your file, or raise a dispute with the credit reference agency. If you have any issues I recommend complaining to the ICO and Financial Ombudsman Service.
