yes you have if you used the word I in the appeal, which is a shame as it was easily won if you kept the drivers details a secret

all that means is you cannot use the POFA2012 arguments, but the rest are still valid and I linked 3 threads to help you formulate your own appeal

you could get an expert on pepipoo forums to look over any drafted popla appeal you post , to double check

use a gmail address if signing up there (not hotmail)

ps:- this one I linked was a driver appeal, because they gave away the drivers details, but they still won at popla

as was this one too , so 2 that won even though they dobbed in the driver

You're overthinking/overworrying this. Advice in last couple of posts should see you through this. Even if you found a 'horizontal ticket' thread, the way to dealing with this would be no different to what is advised now.

The detail of your case is largely immaterial. The PPC isn't interested in which way up your ticket was (they just want your cash), and it's a very weak appeal point to POPLA.

You can waste your and our energy arguing/debating the finer points of this, but it won't help you. Follow the tried and tested method of getting this to POPLA where with a decent appeal this can be kicked into the long grass.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The PCN has been issued for ticket not displayed per the T&Cs on the signs. HOW the ticket was displayed differently to those other threads is utterly irrelevant ... the PCN reason is exactly the same, therefore the challenge (POPLA appeal) is the same.
  • Thank you all for the incredible advice. I've drafted my appeal. Posted this on a new thread to get feedback as I wasn't sure if this one was 'dead'.
