    Hi,

I appealed through POPLA and heard nothing back. Two years on, I received a letter from ParkingEye stating that it's a "LETTER BEFORE COUNTY COURT CLAIM" and "The 28 day period has passed and you have not appealed to POPLA or paid the Parkincg Charge in full", asking for a sum of £100. This was followed up with two letters from a company called Equita acting on ParkingEye's behalf, who asked for a renewed sum of £160 and to contact them otherwise they will proceed to county court. Upon contacting them, they're only interested if you are paying the money.

I know you can't argue the charge is too much but £160 is ridiculous. Do I have a leg to stand on?

Do you have proof you appealed to POPLA ??

Equita is only a debt collector so they are to be ignored
and the extra £60 is a fake addon
    NEVER CONTACT A DEBT COLLECTOR

Clearly PE think it's a fake as the figure claimed is £100
    not £160

Assume that PE has included everything in their paperwork
which is proof of their claim and given you 30 days
    to respond.

No doubt this was a ANPR charge so proof of their
system with logs will be required.
WHY ... because the ATA they belong to, the BPA,
clearly stated on BBC Watchdog that ANPR cameras
    were NOT 100% accurate

    Thanks for replying!

I have got proof I appealed. I've gone past their 30 day deadline which is why I received the two letters of Equita.

Is this something I can leave, it has been two years?! Or do I need to respond to ParkingEye to avoid court?

I've contacted the shops I visited whilst parking there and they say ParkingEye doesn't listen to them anymore. From what I can remember, the landowner wasn't too keen or helpful either.

As Beamerguy says, you can, and should, always ignore a debt collector's letter.

I'll be ignoring Equita but do I need to address ParkingEye? Or can I ignore them too?

Equita are a sister company of ParkingEye.

PE are not usually hesitant in starting litigation.

It is generally thought here that PE pass cases to Equita when they think they have a more uncertain case - using Equita to apply pressure but not much more.

I don't think I can recall a case that has been via Equita and has then progressed to court.

    Do not ignore ParkingEye.

Read up on this in the newbies faq thread (#2 there covers court claims from receipt of the LBCCA right through to the hearing)

If you do get a proper lbcca then don't ignore it!
