Parking Ticket at KFC

On the 20/07/2016, myself and some colleagues visited KFC at the peel centre in Stockport.

As we always do, we park in the 15 mins free parking zones for KFC customers. However, on this day the service was really slow and orders then took a look time to be fulfilled for this group, which caused us to take 35 minutes from arrival past the entry ANPR to going past the exit ANPR camera. (besides the fact is 15 minutes really enough to order and eat your food)

Now KFC have refused to assist on the matter, as the reason for it being slow is due their service on the day and when we were queuing we didn't really realise it was taking as long as it was, otherwise we would have just paid for extra parking.

So where do we go from here? How's best to deal with the situation.

Also to note the issue date of the notice is the 15th August, but it wasn't received until the 19th of August.

    complain to the Peel Centre site office and insist on a cancellation , explaining that "the driver" was held up at the KFC bays due to slow service by KFC and that they should increase the grace period allowed at KFC in those red bays to allow for such problems

    no naming the driver

    appeal it in a similar manner to Excel , not naming the driver but explaining the same scenario, that the "driver" was held up blah blah

    again , do not infer who the driver was

    no mention about paying for parking , this all hinges on grace periods

    As the parking event happened on 20th July, the PCN had to be received within 14 days, (by 3rd August), which clearly it wasn't; so only the Driver can be liable.

    You need to be assertive, Complain to the Head Office, in the local papers, local Radio Trading Standards, (but only in wring), and, especially, on their Facebook page,
    You never know how far you can go until you go too far.

    Excel are an IPC member and dont rely on POFA2012 anyway , they work on the "reasonable" presumption that the keeper is the driver

    I have told you how to deal with it and why, plus the NEWBIES sticky threead tells you how to deal with IPC member appeals

    so its up to you , but whatever you do , DO NOT reveal the drivers details to anybody , dealing with it as KEEPER only

    no , a driver cannot get out of it if they are known to the PPC, not unless it goes to court and a judge finds that they are not liable and dismisses the case

    Excel will proceed on the basis that the keeper and driver are one and the same , they always do and plenty of court cases at the moment show this to be the case

    Excel do not follow POFA 2012 , so have 6 years to enforce the invoice under the small claims (which started in 1973) , now known as an MCOL due to the internet pushing it online (like most things)

    so they wont care that they have not followed POFA2012, as many dont follow it anyway
