Supermarket bump

Options
I was hit by another car in a supermarket car park a couple of weeks ago. I got the drivers details and photographed the damage and their number plate. I spoke to the other party and she agreed to not have any insurance involved as it was a small dent. I got a quote which she agreed to pay for. Now she is not returning my calls or messages. I have proof of payment. What can I do. Should I contact her insurance company anyway or should I get advice from the police? Don't know what to do. I feel really annoyed that she has decided to avoid my calls. It wasn't a lot of money to get fixed but it is the principle. Can you advise please? Thanks

    You've got three choices, really.
    1. Forget it about it and get on with life.
    2. Put it through insurance.
    3. Chase her directly, taking it to a small claim if necessary.

    "...but it is the principle" has been one of the biggest wastes of time, money, energy and blood pressure over the decades.

    If you decide to pursue it with her insurers directly or she through the small claims track then you need to report it to your insurers for information.

    You will need to declare this incident as a pending claim until you recover all of your losses. Until you recover your losses it will go down as an At Fault claim.

    to find out the name of her insurance company (it costs £4) then send her another message something along the lines of:

    "If you do not pay me for the damage as previously agreed, I will have no option but to claim directly from XXXXX who are the insurers of your vehicle."

    If you don't want to go through the insurance then you will have to bluff her.
    It might work, it might not, but when she sees that you have found out who her insurance company is, that may be enough to get her to pay up.

    Send her a 'letter before action' saying how much you want and give her two weeks to respond before you start a small claim in the court. That costs nothing and might spur her into action. If not you still have the option to proceed with the court case or not. If you involve insurance there is no guarantee they won't settle 50/50 if she denies it was her fault and you'll pay an excess and lose NCB.

  • Exactly, either tell them you want the cash there and then or its going to insurance. Simple.
  • I'd try the letter before action first. If you still don't hear anything then go to the insurers. The fact that she has paid so much in the first instance is an admittance of liability. It would probably help to have a copy of the original quote you sent her and a record of sending it too. In any case you have proof of her admittance of liability, proof of a fair quote from an official party and proof that you have tried to settle in an amicable manner with no resolution.
