Housing Benefit non-dep deductions

Hi there, looking for some help if possible.
A relative of mine (19 years old) lives with his Mum and works a few hours a week earning less than the applicable amount.
Because of this he was claiming JSA to top up to the £53 (or whatever it is). Because of his age there was no non-dep deduction applied to his mother's housing benefit.
He has now been ported onto Universal Credit and the Housing Benefit dept at the council are now applying a non-dep deduction because he is not on JSA.
Does this seem right? It seems mighty unfair as nothing income wise has changed. Any help would be greatly appreciated.

yes, this is correct. Have looked at various council websites and they all say the same.
They differentiate between those on UC and not working and those on UC and working.
