Out of Time Statutory Declaration Refused, help with N244

Options
Hi,

Apologies if I have not posted in the correct place.

I sold my car on 27th May 2015. I received two bus lane fines dated 06/06/15.

I told the new owner about this and ignored the first couple of PCN's. After I kept receiving these, I sent a letter to the council via post with evidence stating I was not the owner and had sold my car and sent evidence to prove this. I did not receive a response from them. The evidence I sent was the slip from DVLA that we both filled in, an acknowledgement slip from DVLA, receipt of sale and my bank statement which shows the funds being transferred into my account from the buyer.

I was then contacted by a debt collection agency (TASK enforcement) to whom I sent the evidence I had sent to the council via email. Only a generic reply to my email

Bailiff company (Marston Ltd) contacted me to whom I sent the evidence I had sent to the council via email. Only a generic reply to my email.

Bailiff turned up at my property stated he has a court order (which I was not aware of). sent him away without paying him anything.

Submitted PE2 and PE3 Out of time Statutory Declaration to TEC.

This has been refused which I find astonishing as it is clear I was not the owner/driver. I did not receive some of the correspondence which was allegedly sent by the parties involved including the court order.

I have been told I can get this reviewed via the N244.

I wanted to know if I need a review with or without a hearing? Bearing in mind there are two fines which took place within minutes of each other so I will have to pay £255 for each one if I wanted a hearing.

Also I need some help filling in the N244 in particular section 3 and section 10. What should I make sure to include in this?

Any help advice would be really appreciated!

Thanks

As this is a council problem, please go to http://forums.pepipoo.com/index.php?showforum=30 as they deal with council tickets whereas this forum is for private parking problems.
    Best of luck.

  • Hi Peter,

    Thank you for your reply.

I did try the Pepipoo site as the first port of call however it doesn't seem to be sending me the validation email required to post etc.

I have tried with two different email addresses and still no joy. I have tried the 'resend validation email' but no joy.

If anyone who is a member of Pepipoo who can post on that site, please can you message me and be kind enough to post my issue on the Pepipoo site?

I really need some advice urgently

    Thanks,
  • Not at home at present so can't really help. As bailiffs involved you could try bailiffadviceonline.co.uk, there may be a small charge but worth it.

Thank you for your kind words. The OP (Newbie 909) has been in contact with me and a suitable N244 'review' has been drafted.

Super helpful response from Sheila/Herbie21 again for a poster in trouble.

Well done Sheila, and OP in following forum advice. Some do occasionally! :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
